Core Services Membership Agreement

This Membership Agreement ("Agreement") is entered into between Jackson Massage & Day Spa ("Spa", "we", "us") and the individual enrolling in the Core Services Membership ("Member", "you"). By completing enrollment, you agree to be bound by the terms set forth below.

1. Membership Description

The Core Services Membership provides Member with daily access to the following services at Jackson Massage & Day Spa, each usable once per day:

• Whole Body Cryotherapy eCabin (xCryo)
• Red Light Salt Sauna
• Shake Plate (optional; included with membership)

Services are available during regular business hours. Access is subject to equipment availability, maintenance schedules, and Spa operating hours. The Spa reserves the right to temporarily suspend access to individual services for maintenance or safety reasons without reducing the monthly membership fee.

2. Membership Fee

The monthly membership fee is $69.00 per month for the primary Member. Fees are charged automatically on a recurring monthly basis to the payment method on file on the same date each month as the original enrollment date.

Membership fees are non-refundable. Unused services within a billing period do not carry over and are not subject to credit or refund.

3. Family Member Add-Ons

Household family members may be added to the primary Member's account at the following additional monthly rates:

• Adult household member: $15.00 per month
• Child household member: $10.00 per month

Add-ons are processed through the front desk. Each additional member receives the same daily access to all Core Services included in the primary membership. Additional members are subject to all terms of this Agreement. The primary Member is responsible for ensuring that all household members added to the account comply with Spa policies.

4. Payment Authorization

By enrolling, Member authorizes Jackson Massage & Day Spa to charge the payment method on file on a monthly recurring basis for the total membership fee, including any active family member add-ons. Member is responsible for keeping payment information current. If a payment fails, the Spa will attempt to notify Member and may suspend membership access until payment is resolved.

5. Cancellation Policy

Member may cancel this membership at any time by providing 30 days' written notice to Jackson Massage & Day Spa. Notice may be submitted in person at the front desk or via email to the Spa's contact address. Membership access continues through the end of the current billing period. No refunds are issued for partial billing periods or unused services.

The Spa reserves the right to cancel or suspend a membership at any time if the Member violates Spa policies, misuses services, or engages in conduct that is harmful to other guests or staff. In the event of Spa-initiated cancellation due to policy violation, no refund will be issued for the current billing period.

6. Service Usage Guidelines

Member agrees to the following usage guidelines:

• Each included service may be used once per calendar day.
• Membership access is personal and non-transferable. Sharing membership access with non-enrolled individuals is prohibited.
• Member must check in at the front desk prior to using any service. Sessions are scheduled subject to availability.
• Member agrees to follow all posted safety guidelines for cryotherapy, sauna, and shake plate use.
• Member must disclose any new or changing health conditions to Spa staff.

7. Health Acknowledgment

Member acknowledges that cryotherapy, sauna, and related wellness services involve inherent physical risks. Member represents that they are in adequate physical health to participate in these services and have consulted a physician if they have any medical conditions, concerns, or contraindications.

Contraindications for whole body cryotherapy include but are not limited to: pregnancy, uncontrolled hypertension, Raynaud's syndrome, cold urticaria, open wounds, and certain cardiovascular conditions. Member agrees to disclose relevant health information to Spa staff and to follow all safety instructions.

The Spa reserves the right to deny service to any Member whose health status may present a safety risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Jackson Massage & Day Spa, its owners, employees, and agents shall not be liable for any injury, loss, or damage arising from Member's use of membership services, except where caused by the Spa's gross negligence or willful misconduct. Member assumes all risks associated with participation in cryotherapy, sauna, and other services covered by this membership.

9. Changes to Terms

The Spa reserves the right to modify the terms of this Agreement, the services included in the membership, or the monthly fee with 30 days' written notice to Member. Continued membership after the effective date of any change constitutes acceptance of the updated terms. If Member does not agree to the updated terms, Member may cancel the membership before the change takes effect.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee. Any disputes arising under this Agreement shall be resolved in the courts of Madison County, Tennessee.

11. Entire Agreement

This Agreement constitutes the entire agreement between Member and Jackson Massage & Day Spa with respect to the Core Services Membership and supersedes all prior representations, understandings, or agreements. No modification of this Agreement is effective unless made in writing and acknowledged by the Spa.
